CLARIFICATION TEXT REGARDING THE PROCESSING OF EMPLOYEE CANDIDATE DATA

This Clarification Text Regarding the Processing of Employee Candidate Data has been issued to determine the procedures and principles for the processing of all kinds of personal data processed within the scope of Turkish Personal Data Protection Law No.6698 (“KVKK”) and GDPR. The party submitting this is Benson Excellence Yönetim Danışmanlık Hizmetleri Ltd. Şti. (hereinafter referred to as “Company”)

According to KVKK and  GDPR, “Data Subject” is the person whose data in processed accordance with this text and “Data Controller” is the Company.

  1. Your Processed Personal Data and Scope of Processing

Personal Data is any data that identifies you or makes ypu indentifiable. For example, your name, surname phone number or bank account information are personal data. Processing of your personal data means all kinds of transactions performed on your data such as obtaining, modifying, storing, saving, deleting, explaining, transferring.

Employee candidate may be subjected to some tests using the systems of the business partner or group company to determine employee candidates’ suitability for the job and the data received in this context are kept on Company servers on Europe or Turkey.

  1. Personal Data Retention Periods 

The Company, within the scope of the relevant legislation, especially KVKK and GDPR, personal data shared on the website, in order to use it in the recruitment and evaluation process for the position applied for and other positions suitable for the current or future candidate’s profile, Company abroad or in Turkey can also access it, by storing it in the resume pool, which is foreseen for a period of time in the relevant legislation or for the purposes of processing, stored for as long as required.

  1. Your Rights Regarding Your Personal Data

Data Subject refers to the natural person whose personal data are processed. You, our esteemed Employee Candidates, as the relevant person, have the following rights regarding your personal data processed in accordance with the KVKK and GDPR:

  • Learn whether their personal data was processed,
  • If their personal data were processed, request information on that,
  • Learn the purpose of the personal data processing and whether those were used per the purpose,
  • Learn the third persons to whom the personal data were transferred domestic or foreign,
  • Request correction on personal data if they were processed incomplete or incorrect,
  • Request the deletion or destruction of the personal data under the conditions outlined in the KVKK and GDPR,
  • Request the notification of processes done to the third parties to which the personal data were transferred,
  • Object to any result against the person resulting from the processed data analysis exclusively by automated systems,
  • Demand indemnification in the case that their personal data were processed against the law.

 

  1. Method You Should Follow to Exercise Your Rights

You can send it to the Company by signing it with a secure electronic signature or mobile signature and sending it to the Company’s e-mail address.

Within the scope of the legal obligations regarding the procedures and principles of application to the data controller, you as data subject, must submit your name, surname, signature, if your application is in writing and T.C. identity number if you are a citizen of Republi of Turkey. You must include your identity number, nationality, if you are foreigner, your passport your place of residance or work address for notification as a basis, and lastly, the subject of the requests. In addition, you must include documents confirming the identity and information and documents related to the subject of your request with your application.

In the most efficient way for you to process, you must clearly and understandably state which of your rights you want to exercise on behalf of our business, and the details of the transaction you request.

We would like to emphasize that the subject of the request should be about the personal concerned. If an application is made on behalf of someone else the person making the request must rely on a specially documented authority fort he requested transaction (power of attorney). Unauthorized applications will not be evaluated.

  1. Evaluation of Your Application

We evaluate your applications and get back to you as soon as possible and the latest within 30 days from the date of receipt of your application.
